KSA warns betting operators of Dutch advertising standards

hollandigamingKansspelautoriteit (KSA) the Netherlands’ gambling regulator has issued a new industry guidance regarding national advertising and marketing standards.

KSA has warned international operators that Dutch media owners will only be allowed promote licensed gambling services to Dutch consumers. The regulator states that its advertising policy will be followed throughout all Dutch Media owner channels (print, digital, TV & radio).

Planning for the potential introduction of a nationwide online gambling framework, the regulator stated that new advertising provisions were needed to ensure the protection and safety of Dutch consumers.

The regulator stated that it had previously warned international operators seeking to enter the Dutch online gambling market of the changes when it outlined online gambling standards for its planned online gambling framework in June 2015.

To date European online gambling operators have been left frustrated by the slow implementation and lack of clarity regarding the Netherlands’ Online Gambling framework.

In January several Dutch MP’s contested that online gambling should be taxed at a uniformed rate of 29%, in-line with licensed land-based gambling operators. The uniformed tax appeal has been countered by industry stakeholders claiming that the tax rate will create uncompetitive business conditions.

2016 had been outlined by pro online gambling advocates as the year in which the Netherlands introduces a reformed industry bill. However, the lack of early progress on the matter has seen stakeholders push back their ambitions to 2017.
