Perform hails “unique opportunity” presented by PASPA ruling

Perform Group has called it a “great day” for all stakeholders in the sports industry, after a full reversal of the ban on sports betting outside of Nevada presented the United States with a “unique opportunity” to build a regulated betting market from the ground up.

The Supreme Court of the United States (SCOTUS) ruled that the federal ban on sports betting outside of Nevada was unconstitutional, issuing a 6-3 decision in favour of New Jersey in its battle against the NCAA and major professional sports leagues.

Reacting to the Professional and Amateur Sports Protection Act’s (PASPA) demise, Ross MacEacharn, CEO of the Perform Content division, said that a properly regulated US betting market “works for all parties” from sports fans through to rightsholders and betting operators.

MacEacharn added: “It’s a great day for all stakeholders in the sports industry. This decision gives fans new ways to engage with and enjoy their favorite sports. For betting operators and rightsholders, it presents a unique opportunity to build an efficient, properly regulated betting market from the ground up and design a model for what 21st century betting should be.

“We look forward to working closely with our rightsholder partners, legislators, regulators and clients to shape the reality of a safe, engaging sports betting environment.”

In a lengthy legal summary, SCOTUS made the following judgement: “Congress can regulate sports gambling directly, but if it elects not to do so, each State is free to act on its own. Our job is to interpret the law Congress has enacted and decide whether it is consistent with the Constitution. PASPA is not. PASPA “regulate[s] state governments’ regulation” of their citizens, New York, 505 US, at 166. The Constitution gives Congress no such power. The judgment of the Third Circuit is reversed.”

The floodgates have thus been opened for other states to follow the lead of New Jersey, who, having prepared extensively for such an outcome, may be ready to take the first legal sports bet at its casinos and racetracks in as little as two weeks’ time.

Lawmakers in roughly 20 other states, including New Jersey, Pennsylvania, Connecticut and West Virginia, are also ready to move after introducing legislation to legalise sports betting pending this reversal.
