Kansspelautoriteit (KSA), the Netherlands gambling regulatory authority, has published its reporting requirements that will be applied by all operators observing the new laws of the ‘Remote Gambling Act’ (KOA Act).
The full disclosure of ‘reporting obligations’ has been published on the Dutch government’s official gazette, warning licensees of their duties ahead of the launch of KOA regime on 1 October.
KSA states that reporting duties must be observed as a ‘Board of Director’s obligation’ under the mandate of the KOA Act, which will govern the Netherlands regulated online gambling marketplace as of 1 October.
KOA reporting duties will be applied from 31 December 2021, requiring all licensed operators to provide a CSV file to KSA disclosing quarterly data on the responsibilities of advertising and player recruitment, addiction prevention and the monitoring of betting/gaming integrity.
All quarterly reports must be submitted with a cover sheet presenting an overview of customers administered during the quarter.
On advertising, the KSA communicated that operators must provide a breakdown on marketing spend per vertical including media, sponsorships, affiliates and direct marketing.
The advertising segment will further require operators to disclose data related to bonuses provided, bonuses activated and cashed bonuses.
Addiction prevention reporting requires all operators to submit data on customer care intervention, risk assessments and the analysis of an KSA approved independent auditor during the period.
Quarterly reports must provide a full integrity breakdown on suspected violations, player investigations, suspensions, and further risk analysis of bets, games and promotions.
KSA states that all quarterly AML irregularities on player suspensions must be co-reported by the reports and registered with its central control base.
Further integrity reporting duties will require operators to submit a full breakdown of consumer complaints recorded during the period – tracking disputes in relation to payouts, general complaints, technical issues and customer service irregularities.
The data feedback from advertising, addiction prevention and integrity will be used by KSA to strengthen its policy governing the Netherlands newly established online gambling marketplace.
