SPRIBE wins Aviator trademark dispute against Flutter’s Brazil brand

A Brazilian court has told Flutter Entertainment‘s local brand, NSX Brazil, to remove an Aviator-style game from its product portfolio following a complaint by SPRIBE.

Aviator is one of Poland-based games developer SPRIBE’s flagship games – a social gaming feature based around a flying curve that can crash anytime. Players need to cash out before the plane crashes during gameplay.

The company has been extremely protective of the product and trademark over the past few years, including using legal action to prevent unauthorised use of it. It was involved in long-running litigation with Georgian firm Aviator LLC, for example.

In the case of NSX, SPRIBE took its case to the Court of Justice of Pernambuco (TJPE), citing its registration of the Aviator trademark with Brazil’s National Institute of Industrial Property (INPI), which grants it exclusive rights to operate the trademark under the Industrial Property Law.

The court subsequently sided with SPRIBE and has told NSX to immediately stop using the Aviator trademark, including ‘identical or confusingly similar signs, such as the reproduction of visual, graphical, or audiovisual elements’.

“This interim decision in Brazil marks a significant milestone in SPRIBE’s worldwide strategy to safeguard its assets,” a SPRIBE statement read.

“The company is actively monitoring markets across all continents and will continue to enforce its trademark and copyright protections in every jurisdiction.

“SPRIBE remains committed to taking all necessary legal actions against infringer to protect the integrity of the original “Aviator” experience and ensure a fair, transparent environment for its global player base.”

NSX forms part of the Brazilian arm of Flutter Entertainment, created in 2025 following the January launch of the regulated market – known locally as the ‘Bets’ market.

Flutter Brazil was created via Flutter’s acquisition of NSX, the operator of Betnacional, one of the largest betting brands in Brazil, with activity predating the Bets market launch.

Flutter subsequently rolled both NSX/Betnacional and the local activities of its Betfair sportsbook and exchange under the Flutter Brazil umbrella.

SPRIBE noted that it had worked with Betnacional previously under an agreement dating back to 2022. The legal dispute between the two arose in 2025 when an Aviator game was launched on the NSX platform.

“While SPRIBE is deeply loyal to its clients and values long-term professional relationships, the company stated that it cannot tolerate violation of its intellectual property,” SPRIBE’s statement continued.
